1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of PawPeer's website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, creating an account, completing a booking flow, checking any required acceptance box, or continuing to use PawPeer after updates become effective, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Who We Are
PawPeer LLC ("PawPeer," "we," "our," or "us") operates pawpeer.io, a pet-care coordination and pet-sitting swap platform that helps connect pet owners with other users for bookings, sleepovers, walking, sitting, messaging, payments, dispatch, and related features.
3. Eligibility
You must be at least 18 years old, have authority to accept these Terms, and provide accurate, current, and complete information when registering and using the Service. We may require identity, eligibility, fraud, safety, or compliance verification before allowing access to certain features.
4. Account Registration, Security, and Verification
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify PawPeer promptly of any unauthorized use or suspected breach. We may suspend, restrict, or terminate accounts that violate these Terms, present safety concerns, or fail verification requirements.
5. KYC, Identity Checks, and Trust Verification
PawPeer may require certain users, providers, hosts, walkers, sitters, or other participants to complete know-your-customer (KYC), identity verification, selfie matching, document verification, background checks, fraud screening, or similar trust and safety reviews through PawPeer or approved third-party vendors. By using the Service and submitting information for verification, you authorize PawPeer and its vendors to collect, process, validate, and retain that information as reasonably necessary for compliance, fraud prevention, safety, support, and platform integrity. Failure to complete or pass required verification may limit or prevent access to dispatch, booking, payout, messaging, or other platform features.
6. Location Services, Live Tracking, and Dispatch Features
Because PawPeer may support real-time dispatch, live status updates, handoff coordination, route monitoring, and location-aware booking experiences, certain features may require access to device location data, including background or precise location where permitted by law and enabled by the user. By using location-enabled features, you authorize PawPeer to collect, process, and use location data for dispatch coordination, booking fulfillment, safety, fraud prevention, support, and service improvement, consistent with our Privacy Policy. If you disable required permissions, some features may not function properly or may be unavailable.
7. Acceptable Use
You agree not to use the Service for unlawful, harmful, deceptive, abusive, fraudulent, or infringing purposes; misrepresent yourself, your pet, your identity, your location, or your affiliation; circumvent payment, safety, verification, dispatch, or platform controls; interfere with platform security or operations; or attempt to take transactions off-platform in violation of our policies.
8. Marketplace Role
PawPeer is a platform that connects users. PawPeer does not directly provide pet care services, boarding, walking, veterinary care, transportation, or supervision. PawPeer does not employ or control users who offer or receive services through the Service, and PawPeer does not guarantee the quality, safety, legality, suitability, reliability, location accuracy, or conduct of any user, pet, service, home, or interaction.
9. Bookings, Payments, Fees, and Subscriptions
Payments may be processed through trusted third-party providers, including providers such as Stripe, Paystack, or M-Pesa depending on region and product configuration. By confirming a booking, purchase, or subscription, you authorize the applicable charges, fees, taxes, and renewal terms presented to you. Except where required by law or expressly stated by PawPeer, charges are non-refundable. PawPeer may change pricing, fees, or subscription terms prospectively.
10. PawPeer Care Shield
PawPeer offers Care Shield for eligible bookings, subject to the Care Shield policy, coverage limits, exclusions, reporting deadlines, evidence requirements, and claim review standards then in effect. Care Shield is not insurance, is not a warranty, is not a guarantee of reimbursement, and does not replace personal insurance or a user's direct responsibility for losses. Care Shield does not create any obligation for PawPeer to reimburse users and does not replace the responsibility of users to resolve claims directly. PawPeer may approve, partially approve, deny, modify, suspend, or discontinue Care Shield in its discretion, subject to applicable law. Learn more at Care Shield.
11. Pet Profiles and Required Disclosures
You must provide truthful, complete, and current information about your pet, including age, size, breed, vaccination status, behavioral history, bite history, medical conditions, medications, anxiety, reactivity, escape risk, compatibility concerns, and any other information reasonably relevant to safety. You must promptly update your pet profile if circumstances change. Failure to disclose known issues or risks may result in claim denial, account restriction, removal from the platform, and full responsibility for resulting losses.
12. Safety Responsibilities and Assumption of Risk
Pet interactions involve inherent risks. By using PawPeer, you acknowledge and accept that pets may behave unpredictably and that bookings, sleepovers, walks, handoffs, introductions, dispatches, and in-home visits can result in injury, illness, emotional distress, property damage, escape, theft, or other harm. You voluntarily assume all risks arising from your participation in the Service, including risks caused by another user's acts or omissions, except to the extent such liability cannot be disclaimed under applicable law.
13. User Responsibility for Pets, Property, and Conduct
Each user is solely responsible for their own actions, omissions, home environment, guests, children, other animals, and pet behavior. You are responsible for determining whether another user, pet, or home is appropriate for your needs. You are also responsible for complying with applicable laws, leash rules, housing restrictions, vaccination requirements, and any obligations relating to your pet or property.
14. User-to-User Interactions and Liability
All bookings and interactions arranged through the Service are between users. Except for any limited support expressly described by PawPeer in writing, users are solely responsible for resolving claims, disputes, losses, injuries, damages, vet costs, property damage, and other liabilities arising out of user-to-user interactions. PawPeer is not a party to those arrangements and is not responsible for monitoring or enforcing user performance.
15. Platform Credits and PawPoints
If PawPeer offers points, credits, promotional balances, or similar platform benefits, they have no cash value unless expressly stated otherwise. PawPeer may reverse, limit, expire, or cancel credits or points in cases of fraud, abuse, disputes, refunds, reversals, or policy violations. Booking cancellation, rescheduling, and refund outcomes may depend on the specific product flow and any cancellation policy displayed at the time of booking.
16. Care Shield Claims and Platform Support
To request Care Shield support, users must follow the in-app or support reporting process, submit requested evidence, and comply with timing requirements. Incidents must be reported within 24 hours of the booking end time unless PawPeer states a different deadline in the active Care Shield policy. PawPeer may request receipts, photos, vet records, messages, location records, dispatch logs, and other supporting documentation, and may suspend accounts while investigating incidents.
17. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWPEER DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, PAWPEER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, THAT ANY LOCATION DATA WILL BE PRECISE OR AVAILABLE AT ALL TIMES, OR THAT ANY USER, PET, OR BOOKING WILL BE SAFE, SUITABLE, LEGAL, OR SUCCESSFUL.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PAWPEER LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PROPERTY, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, PAWPEER'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE TOTAL AMOUNT PAID TO PAWPEER FOR THE APPLICABLE BOOKING GIVING RISE TO THE CLAIM.
19. Indemnification
You agree to defend, indemnify, and hold harmless PawPeer LLC and its affiliates, officers, directors, employees, contractors, agents, and service providers from and against any claims, actions, demands, disputes, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to (a) your access to or use of the Service, (b) your pet, (c) your content, profile information, or disclosures, (d) your breach of these Terms, or (e) your violation of law or the rights of any person or entity.
20. Suspension and Termination
We may suspend, limit, investigate, or terminate access to the Service at any time for safety reasons, legal reasons, fraud prevention, policy enforcement, verification failure, non-payment, abusive conduct, or any conduct we believe may expose PawPeer or other users to harm or risk. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive will survive.
21. Intellectual Property
The Service, including its software, designs, text, graphics, logos, trademarks, and other content, is owned by PawPeer LLC or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted in writing, you may not copy, modify, distribute, reverse engineer, create derivative works from, or exploit the Service or its content.
22. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. To the fullest extent permitted by law, you and PawPeer agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will first be attempted to be resolved informally. If not resolved, the dispute shall be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if it qualifies. YOU AND PAWPEER WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. If a court determines that this arbitration section is unenforceable as to a particular claim, then that claim shall be resolved exclusively in the state or federal courts located in San Diego County, California, and the parties consent to that forum.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law rules, except to the extent preempted by federal law or superseded by the arbitration requirements above.
24. Privacy
Your use of the Service is also subject to PawPeer's Privacy Policy, which explains how PawPeer collects, uses, discloses, stores, and protects personal information, verification information, messaging data, payment-related information, and location data. Read the Privacy Policy.
25. Messaging Terms
By providing your mobile phone number, checking any applicable consent box, and using the Service, you agree to receive account, booking, security, support, service, and optional promotional messages from PawPeer. Message frequency varies. Message and data rates may apply. You may opt out by replying STOP or UNSUBSCRIBE, and request help by replying HELP or contacting support@pawpeers.com. PawPeer uses messaging data in accordance with its Privacy Policy and does not sell or transfer your mobile number for third-party marketing purposes.
26. Changes to the Service and These Terms
PawPeer may modify or discontinue features of the Service at any time. We may update these Terms from time to time by posting the updated version at Terms of Use. Unless otherwise stated, changes become effective when posted. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
